JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-07-2021 Heard Mr. Rajendra Kumar Jain, learned counsel for the petitioner and Mr. Purushottam Jha, learned counsel for the Nagar Parishad, Madhubani through video conferencing. The present writ application has been filed for a direction to the respondent -Nagar Parishad, Madhubani to pay the retiral benefits of the petitioner along with statutory interest. Learned counsel for the petitioner submits that petitioner has retired from Nagar Parishad, Madhubani on 30.6.2019 and no amount has been paid to the petitioner towards his retiral benefits.

Mr. Purushttam Jha, learned counsel for the Nagar Parishad, Madhubani submits that due to intervening Corona pandemic the admitted dues of the employees could not be paid and if the petitioner files a detail representation before Respondent No.-3 i.e. Executive Officer, Nagar Parishad, Madhubani for payment of retiral dues, the same shall be

Having heard learned counsel for the parties and in view of the submission made by learned counsel appearing for Nagar Parishad, Madhubani, this writ application is disposed of with a direction to the petitioner to file a detailed representation before Respondent No. 3 within a period of two weeks from today.

Needless to say that if such representation is filed by the petitioner the same shall be disposed of in accordance with law by a reasoned order within a further period of two months from the date of filing of representation and if any admissible amount is found payable to the petitioner, the same shall be paid by the respondents within one month from the date of disposal of the representation.
