JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This is an application for grant of anticipatory bail in connection with Ander P.S. Case No.133 of 2018, disclosing offences under Sections 272, 273, 308 of the Indian Penal Code and Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioners are named in the F.I.R. Recovery of 3456 liters of illicit liquor.

Submission of the learned counsel for the petitioner is that on the suspicion he has named in the F.I.R. There is nothing against the petitioner.

Heard learned A.P.P. also, who has opposed the prayer for bail by stating that on a secret information police raided the place of occurrence and recovered the said liquor and petitioner is named in the F.I.R.

Having heard both sides, in view of the allegation and

No.21555 of 2019(3) dt.21-06-2019 2/2 the quantity of the liquor recovered, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned trial court on its own merit.
