JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30 (a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2022, charge-sheet has been submitted in the case and has antecedent of three cases. Allegation is of recovery of 18.4 litres of liquor from a karha.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and he came to be implicated merely on the basis of suspicion.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.20254 of 2022(2) dt.29-04-2022 2/2 bail of the petitioner.

Considering the fact that the petitioner is in custody since 19.01.2022, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Haspura P.S. Case No. 27 of 2022.
