Heard learned counsel for the petitioner and learned Government Pleader No. 8 for the State. In the second supplementary affidavit filed today the petitioner has enclosed copy of the letter dated 7.9.2016 in which it is stated that after considering the show cause filed by the petitioner, the departmental proceedings against the

Patna High Court CWJC No.12302 of 2015 (2) dt.22-10-2016 2/2 petitioner have been dropped and his name has been removed from the list of Officers against whom allegations are pending. It is thus, submitted that now there is no hindrance to the payment of the retiral dues of the petitioner.

On a consideration of the aforesaid facts and circumstances and after hearing learned counsels for the parties, the writ application is disposed of with a direction to the respondents to ensure that the entire post retiral dues of the petitioner are paid to the petitioner within a period of three months from the date of receipt/production of a copy of this order.
