JUSTICE ASHUTOSH KUMAR ORAL ORDER 02/- 17/07/2020 Heard Mr. Ram Prawesh Kumar, learned counsel for the petitioner and Mr. Choubey Jawahar, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Kishanganj P.S. Case No. 607 of 2019 instituted for the offences under Sections 341, 323 and 308 of the Indian Penal Code.

It appears from the F.I.R. that there is an allegation of assault by fists and slaps and an attempt also is stated to have been made for strangulating the informant.

It has been submitted on behalf of the petitioners that there is no injury on the person of the informant and the petitioner is a person of clean antecedent.

Regard being had to the accusation afore-stated and the clean antecedent of the petitioner, he, in the event of his arrest/surrender before the Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection Kishanganj P.S. Case No. 607 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
