JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 69.2 liters country made liquor and 375 Ml. Indian Made foreign liquor are said to have been recovered in this case and the prosecution report goes to show that the aforesaid recovery was made from the shop as well as house of the petitioner.

Submission on behalf of the petitioner is that the prosecution report does not disclose as to whether the aforesaid recovery has been made from the house or from the shop of the petitioner and, as a matter of fact, petitioner has been implicated in this case on account of political rivalry.

No.26165 of 2016 (2) dt.11-07-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 8.05.2016, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Case No. C-7-127 of 2016.
