JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Shambhuganj P.S. Case No. 61 of 2018 registered under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was also added.

Considering that the case is based on dying declaration of the informant who had alleged that the petitioner and others mercilessly assaulted him with iron rod and lathi as a result of which he had sustained grievous injuries for which he was undergoing treatment in Mayaganj Hospital at Bhagalpur and later, he was referred to PMCH, Patna and in

Patna High Court Cr.Misc. No.57586 of 2018 (2) dt.28-09-2018 2/2 course of treatment, he succumb to those injuries, I am not inclined to grant her pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected. (Ashwani Kumar Singh, J.) Kanchan/SkSuman.
