JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Mansi P.S. Case No. 103 of 2015 for the offences instituted under Section 366(A) of the IPC.

The prosecution story, in brief, is that on 24.04.2015, the victim Arti Kumari, the minor daughter of the informant, Ranjeet Singh, went to study but did not return. The informant searched her but in vain. The informant has suspicion that co-accused Amit Kumar Mandal and this petitioner have kidnapped his daughter. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the victim girl has made her statement under Section 164 Cr.

Patna High Court Cr.Misc. No.39484 of 2015 (2) dt.29-09-2015 2/2 P.C. where she has alleged that the son of this petitioner had taken her to different parts of the country and when she objected she was brought back to her home but subsequently vide Annexure-3 she has filed a petition in the court below where she has admitted that she has married the son of the petitioner and she is living happily with the son of this petitioner. Further from perusal of the certificate issued by the Bihar School Examination Board it is apparent that the victim is aged about 21 years. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Mansi P.S. Case No. 103/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
