JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and other F.I.R. named accused are said to have committed murder of informant's husband but, admittedly, prior to institution of the present case, one Anita Devi lodged Karai Parsurai P.S.Case No. 102 of 2015 against the deceased of the present case and others. According to that case, the deceased of the present case had committed murder of her husband on 04.09.2015.
Submission on behalf of the petitioner is that the deceased of the present case was killed by some unknown persons and none has seen the actual killing of the deceased but in
Patna High Court Cr.Misc. No.31182 of 2016 (2) dt.11-08-2016 2/2 retaliation to the institution of Karai Parsurai P.S.Case No. 102 of 2015, the informant of the present case lodged this case. It is further submitted that petitioner does not have any concern either with the deceased or with the informant of the present case. It is further pointed out that having similar allegation, co-accused Bakhori Singh has already been granted privilege of bail by a coordinate Bench of this Court. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Hilsa, Nalanda in connection with Session trial no. 113 of 2016 arising out of Karai Parsurai P.S.Case No. 103 of 2015.
