JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 394 of the Indian Penal Code.
The accusation is that the informant and one Raushan Kumar were going to their maternal uncle's (Phupha) house and when they were surrounded by the accused persons including the petitioner and mobile and cash of Rs.3250/- were snatched. On alarm being raised the villagers Jadolal Rai and Chintu Kumar came to the scene and identified the accused as Birjesh Rai and the petitioner while fleeing away.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.34621 of 2015 (2) dt.01-09-2015 2/2 that only on suspicion the accusation has been levelled and the informant has retracted from the initial version. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Kalyanpur P.S. Case No.210 of 2013 pending in the court of learned C.J.M. East Champaran at Motihari.
This application is disposed of with the aforesaid observation/direction.
