JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-07-2016 Heard the learned counsel for the petitioners as well as the learned A.P.P for the State.
The petitioners want to renew their prayer for bail which was earlier rejected by order dated 15.02.2016 passed in Cr. Misc. No. 5671 of 2016 in the light of the observation made therein to renew their prayer for bail after remaining further four months in custody and the trial has not been concluded. The learned A.P.P. fairly submits that in the light of the observation now lenient view can be taken as the petitioners are aged about 70 years.
In the facts and circumstances as stated above, now the petitioners are directed to be released on bail on furnishing bail
Patna High Court Cr.Misc. No.31287 of 2016 (2) dt.27-07-2016 2/2 bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Muzaffarpur in S.T. No. 576 of 2015 arising out of Paroo P.S. Case No. 99 of 1997, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
