04-12-2017 Heard Sri Bijay Prakash Singh, learned counsel for the petitioner and Sri Uma Shankar Prasad Singh, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 08-09-2017 in Maharajganj P.S. Case No. 154 of 2017 registered for offence under Sections 272, 273, 308, 420, 414, 34 of the Indian Penal Code and Sections 30 (I), 41(1) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner's name in the case has come in the confession made by co-accused before the police and save & except confessional statement, there is no other material to connect the petitioner. Learned counsel for the petitioner has also drawn my attention to statement made in paragraph - 3 of the petition to show that

Patna High Court Cr.Misc. No.56591 of 2017(2) dt.04-12-2017 2/2 petitioner is having clean antecedent.

Considering the fact that petitioner's name has come in the confessional statement of the co-accused made before the police, clean antecedent as well as period of custody, let the petitioner namely Motey Chaudhary @ Mote Chaudhary be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Siwan in connection with Maharajganj P.S. Case No. 154 of 2017.
