JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 25(1-B)a and 26 of the Arms Act.

The prosecution is that one live cartridge and one country made pistol were recovered from the house of co-accused Amar Sharma. The petitioner was one of the seizure list witnesses. It is submitted by learned counsel for the petitioner that during investigation, I.O. misdirected by recording that seized arms were kept by this petitioner in the house of Amar Sharma. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named

No.33627 of 2015 (2) dt.14-08-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 281 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
