In this case, the petitioner is seeking bail in connection with Tariyani P.S. Case No. 22 of 2016 (G.R. No. 97 of 2016) registered for offences under sections 25(1-b), 26 & 35 of the Arms Act.
As per allegation, the police received secret information and raided the house of the petitioner and from there huge quantities of arms were recovered. Learned counsel for the petitioner has submitted that all the materials are rusted and the same cannot be said to be for active use and there may be a possibilities of dumping the same in the house of the petitioner for implication him in the present case.
Patna High Court Cr.Misc. No.27218 of 2016 (2) dt.15-07-2016 Looking to the materials recovered as also taking into account the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner, namely, Bhagirath Thakur is rejected. However, liberty is given to the petitioner to renew his prayer for bail after one year of his judicial custody. (Shivaji Pandey, J) Rishi/- U T
