JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 12.4.2016 for the offences punishable under Sections 224 and 332 of the Indian Penal Code.

It would appear from perusal of First Information Report as well as impugned order that petitioner was allegedly arrested in Vidyapati Nagar P.S. Case No. 60 of 2014 and he was kept in police Hazat, but, he managed to escape from police custody after assaulting the Chowkidar deputed there. However, it is informed on behalf of the petitioner that petitioner was never arrested in connection with Vidyapati Nagar P.S. Case No. 60 of 2014 and taking note of the aforesaid fact, a Bench of this Court

Patna High Court Cr.Misc. No.29814 of 2016 (2) dt.28-07-2016 2/2 vide order dated 13.7.2015 granted privilege of anticipatory bail to the petitioner in Cr. Misc. 24346 of 2012.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that Section 224 of the Indian Penal Code, is bailable in nature, whereas no injury report of informant has been brought on record, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of Shri V.K. Singh, Judicial Magistrate, 1st Class, Dalsingsarai, in connection with Vidyapati Nagar P.S. Case No. 61 of 2014. (Hemant Kumar Srivastava, J) S.Ali/- U T
