JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
Petitioner is named in the first information report but according to F.I.R. itself, it was co-accused, Shubhankar who gave dagger blow to informant. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 15.06.2016. Moreover, having more or less similar allegation, one co-accused, Devanshu Shekhar @ Majar has already been granted privilege of bail by this Court.
