The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 18 litres of Tara U.P. Soufi Wine was recovered from the back carrier of the cycle which was being carried by the petitioner. It is urged that the petitioner has remained in custody since 22.09.2017, i.e., about two months. It is claimed that the petitioner is having clean antecedent.

No.56248 of 2017(2) dt.23-11-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Motihari in connection with Adapur P.S. Case No. 267 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
