The petitioners apprehend their arrest in registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The petitioners are alleged to have indiscriminately assaulted the informant Shailesh Prasad with iron rod and lathi and Arjun Singh is said to have stabbed the informant with knife on his waist.
It is submitted that there is counter version bearing Marhaura P.S. Case No. 136 of 2015 and the petitioners are alleged to have indiscriminately assaulted the informant but only two injuries that too swelling and superficial are found on the body of the informant which are simple in nature.
Patna High Court Cr.Misc. No.36031 of 2015 (3) dt.02-11-2015 2/2 Learned APP did not dispute the facts.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Marhoura P.S. Case No. 135 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
