The petitioner is languishing in custody since 07.11.2018 in a case registered for the offences punishable under Sections 420, 467, 468, 469, 471, 414, 489(A), (B), (C)/34 of the I.P.C. The prosecution case is that three persons travelling on Apache motorcycle were apprehended and from the possession of apprehended co-accused Ashish Kumar Singh @Ajit Kumar Singh, one fake currency note of Rs.500/-and Rs.200/- denomination were recovered and from the possession of petitioner, two fake currency note of Rs.200/- denomination were recovered.

It is submitted by learned counsel for the petitioner that even assuming the accusation to be true, only offence under Section 489(C) of the IPC is made out, which is bailable. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal

Learned APP submits that the recovery has been made from the conscious physical possession of the petitioner. Considering the fact that investigation has already been concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Gorea Kothi P.S. Case No.222 of 2018.
