Petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366A of the Indian Penal Code and under Section 8 and 12 of POCSO Act.
Allegation against the petitioner is of kidnapping the daughter of the Informant for the purpose of marriage. Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case. The victim was recovered and in her statement recorded under Section 164 of Cr.P.C has stated that she had gone with the petitioner on her own volition and sweet will. Petitioner has got no criminal antecedent and is in custody since 03.01.2022. Considering the aforesaid facts and circumstances of the

No.19616 of 2022(2) dt.12-07-2022 2/2 case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Shikarpur P.S. Case No. 753 of 2021, with following conditions:-
(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.
(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
