Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 9.11.2017 passed in Cr.Misc.No. 48598 of 2017 and allegation against the petitioner is of recovery of 5 kg. of ganja from his possession.

Submission of learned counsel for the petitioner is that petitioner is in custody since 2.6.2017 and recovery is less than commercial quantity and co-accused, from whose possession 6 kg. of ganja was recovered, has been granted bail by a co-ordinate Bench of this Court vide order dated 5.9.2018 passed in Cr.Misc.No. 26199 of 2018.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.56895 of 2018 (2) dt.19-09-2018 2/2 circumstances, as stated above and also considering the period of detention in custody, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Bhojpur at Ara, in connection with Ara Town P.S.Case No. 299 of 2017, corresponding to NDPS Case No. 19 of 2017, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
