JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This application, for grant of anticipatory bail, arises out of Dumariagha P.S. Case No. 73 of 2018, disclosing offences under Sections 447, 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.

Allegation against petitioner no. 1 is that he assaulted the daughter of informant and allegation against petitioner no. 2 is that he assaulted the informant on his back and chest and further allegation against petitioner no. 2 is of snatching cash worth Rs. Ten Thousand.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and only general and omnibus allegation has been levelled against these

Patna High Court CR. MISC. No.18566 of 2019(3) dt.06-05-2019 2/2 petitioners in the background of land dispute, whereas, specific allegation is against co-accused Munni Lal Sahni of assaulting the informant by means of iron rod on the neck. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Dumariagha P.S. Case No. 73 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
