The petitioner is apprehending his arrest in connection with Excise Case no.51 of 2019 dated 4.2.2019 , registered for offences punishable under Sections 2(e), 3, 5, and 13 of Bihar Excise (Mahua Flowers) Rules, 2006.

Allegation against the petitioner is of recovery of 500 kg. of Mahua Flowers from a vehicle, the petitioner is named in the FIR and he has been made accused in another case also with respect to recovery of 750 kg. of Mahua flower. Submission of the learned counsel for the petitioner is that the vehicle is not of the petitioner nor he is driver and he has been falsely implicated in this case.

No.18138 of 2019(2) dt.02-04-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Excise Case No.51 of 2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
