Mr. Nand Kishore Pd ====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 14-12-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Madhubani Town P.S. Case No. 379 of 2014 registered under Sections 341, 323, 353, 427 and 504 of the Indian Penal Code.

Petitioners along with Phuldeo Yadav and others intruded into the office of the informant who happens to be District Programme Officer, Establishment, Madhubani and assaulted and misbehaved with him blaming him not doing the work of Chulhai Mahto and also tore register. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place.

Patna High Court Cr.Misc. No.55819 of 2018(2) dt.14-12-2018 2/2 Petitioners have been falsely implicated in the case. The allegation levelled against the petitioners is not specific rather omnibus. Petitioners being the social worker used to raise voice against corruption and irregularity committed by the informant and his staff and due to aforesaid annoyance the informant has falsely implicated the petitioners in the case. Co-accused Phuldeo Yadav who is said to have assaulted the informant has been enlarged on anticipatory bail by a co-ordinate Bench of this Court.

In the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani in connection with Madhubani Town P.S. Case No. 379 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
