The petitioner is apprehending his arrest in connection with Siwan Muffasil P.S.Case no.588 of 2018 , registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(A) , 41(i) of the Bihar Excise Amendment Act..
Allegation against the petitioner is about recovery of 432 ltrs. of liquor from the bushes . The petitioner is named in the FIR but all the accused persons succeeded in fleeing away. Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession and he has no criminal antecedent.

No.20378 of 2019(2) dt.07-05-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cum Special Judge, Excise Siwan, in connection with Siwan Muffasil P.S.Case no.588 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation of the case..
With the aforesaid direction, this application is allowed.
