JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Section 395 of the I.P.C.
Allegation against the accused persons including the petitioners is of looting Rs.1,24,600/- and five mobiles. It has been submitted on behalf of the petitioners that the petitioners are in custody since 6.5.2016 and the charge sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. There is no recovery of any incriminating article from the possession of the petitioners. From perusal of paragraphs 7, 8, 9 and 24 of the case diary, it is
Patna High Court Cr.Misc. No.29646 of 2016 (3) dt.06-09-2016 2/2 evident that the petitioners were working as labourers in the unit of the informant. There was admitted dispute in respect to the wages of the petitioners and for the said reason a false case has been instituted against them.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria (Muffasil) P.S. case No.278 of 2016.
