JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-386, 387 & other minor sections of the Indian Penal Code.
Petitioners are named in the first information report with allegation that they as well as other accused, forcibly, cut and took away the crop from the field of the informant but submission on behalf of petitioners is that there is long standing land dispute between the parties and that is the reason, the informant lodged not only this false case but also, some other cases against the petitioners and others.
Patna High Court Cr.Misc. No.36845 of 2016 (2) dt.01-09-2016 2/2 Learned counsel, appearing for informant points out that petitioner No. 2 namely, Mahesh Yadav was convicted in a murder case and when he got bail from the appellate court, he along with others committed the present occurrence. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Khagaria (Muffasil) P.S. Case No. 526 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Khagaria subject to condition that if petitioners make any attempt to terrorize or to tamper with the prosecution witness, learned court below shall be at liberty to cancel the bail bonds of the petitioners after due and proper inquiry.
