Petitioner seeks bail in Dighalbank P.S. Case No.103 of 2018 instituted for the offence under Section(s) 414 Indian Penal Code and Section 11(a) (d) of Animal Cruelty and Improvement Act & Section 4 of Bihar Preservation and Improvement Animal Act.

It is alleged that petitioner was going with cattle to nearby market. He became nervous on seeing police party and attempted to run away. He was apprehended by the police. Seizure list was prepared and sixteen cattle as mentioned in the written report were recovered.

Counsel for the petitioner submits that all those cattle were purchased by the petitioner from nearby Alam Maweshi

Patna High Court CR. MISC. No.21016 of 2019(2) dt.04-04-2019 2/2 Haat on 23.11.2018. It is further submitted that in course of release of those cattle police has submitted his report dated 11.12.2018 (Annexure-3) stating that aforesaid cattle had been purchased legally from nearby market.

Petitioner is in custody since 27.11.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Dighalbank P.S. Case No.103 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
