The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code which was subsequently converted under sections 406, 409, 420, 379 and 411 of the Indian Penal Code. As per the prosecution case, while the informant was coming after collecting Rs.1,24,340/ in his bag the accused persons on the point of fire arm took away the bag of the petitioner.

It is submitted by learned Senior Counsel appearing for the petitioner that the petitioner happens to be the informant of the case. In course of the investigation he was falsely

No incriminating article has been recovered from his possession. He is in custody since 13.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with K. Nagar P.S. Case no. 352 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea.
