Petitioner seeks bail in a case registered for the offence punishable under Sections 304B, 201/34 of the Indian Penal Code.
Informant who is father of the victim has alleged that 2 years before he married his daughter to the brother of the petitioner and thereafter she was being subjected to torture for non fulfillment of demand of Rs. 1.5 lakhs and on 31.08.2020 he came to know that her daughter was killed. Learned counsel for the petitioner submits that she is innocent and has been falsely implicated in this case only for the reason that she is the Sister-in-Law (Nanad) of the deceased. Patna High Court CR. MISC. No.19596 of 2022(2) dt.12-07-2022 2/2 Sasural and has no concern with the mess and business of her brother. Similarly situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 07.01.2022 in Criminal Miscellaneous No. 38384 of 2021. Petitioner has got no criminal antecedent and is in custody since 09.01.2022.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Rajepur P.S. Case No. 99 of 2020, with following conditions:-
(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.
(2) The petitioners shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
