The petitioner seeks anticipatory bail in connection with Muffasil P.S.Case No. 619 of 2018, registered for offences punishable under Sections 147, 148, 148, 447, 448, 323, 307, 379 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R., allegation against the petitioner is that he came along with other unknown persons to the house of the informant and attacked and assaulted to the informant with intention to kill him, causing head injury.
Submission of the learned counsel for the petitioner is that injury report does not show that injury is grievous and he has no criminal antecedent. It is submitted that the similarly situated co-accused has been granted anticipatory bail vide order dated 13.03.2109 passed in Cr. Misc. No. 5197 of 2019.
Patna High Court CR. MISC. No.18198 of 2019(2) dt.04-04-2019 2/2 Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Muffasil P.S.Case No. 619 of 2018, to the satisfaction of learned Chief Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
