JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 25.5.2016 registered for the offences punishable under Section 47(a) of the Bihar Excise Amended Act, 2016.

No doubt, the country made liquor and Mahua as well as the apparatus of making liquor, were recovered from a bush but not from the conscious possession of the Petitioner, and it is stated that the petitioner had only assisted in preparing liquor, as a labourer.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten

Patna High Court Cr.Misc. No.29534 of 2016 (2) dt.26-07-2016 2/2 Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No. 123 of 2016.
