JUSTICE SUDHIR SINGH ORAL ORDER 02-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Section 394 of the Indian Penal Code.

Allegation is that three accused persons on the point of pistol looted belongings of the informant and his mother. It has been submitted on behalf of the petitioners that they are in custody since 3.2.2016. Chargesheet has been submitted against the petitioners. No allegation of tampering of witnesses is alleged against the petitioners. They are not named in the F.I.R. They have not been put on T.I.P. Petitioners have been made accused on the basis of their own confession before the police. No looted articles are said to have been recovered from the possession of the petitioners.

On behalf of the State, it is submitted that petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional
