JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Tariyani Chapra P. S. case no. 17/2018 registered under sections 307, 379 and other allied sections of the IPC. Submission on behalf of petitioner is that there is a case and counter case between the parties but subsequently, both parties settled their dispute amicably and filed compromise petition which is evident from the perusal of Annexure-2 to this petitioner. The petitioner is a lady and except sections 307 and 379 almost all the sections are bailable in nature.
No doubt, section 307 of the IPC is not a

No.57276 of 2018 (2) dt.20-09-2018 compoundable offence but taking note of this fact that both parties are co-villagers and neighbours and they have settled their dispute amicably, I think it proper to extend the privilege of anticipatory bail to the petitioner. Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sheohar in connection with Tariyani Chapra P.S. case no. 17/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
