The petitioner seeks regular bail in connection with Araria PS case no. 921 of 2018 registered for the offence punishable under Sections 379 of Indian Penal Code and 66 (C) of the I.T. Act.
The allegation is regarding transfer of a sum of Rs. 43,500/- from the account of the informant to the account of the petitioner herein.
The learned counsel for the petitioner submits that the petitioner is totally unaware as to how the said amount of Rs. 43,500/- has been deposited in his account and infact, he himself is also the victim of cyber crime, inasmuch as a sum of Rs. 15,000/- has been withdrawn from the account of the
Patna High Court CR. MISC. No.18192 of 2019(2) dt.02-04-2019 2/2 petitioner. It is further submitted that the petitioner is willing to deposit a sum of Rs. 43,500/- with the Nazarat of the concerned Civil Court in order to show his bonafides. The petitioner is said to be having clean antecedent and he is languishing in custody since 08.01.2019.
Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for the release of the petitioner on regular bail immediately upon deposit of a sum of Rs. 43,500/- with the Nazarat of the concerned court as well as subject to such other conditions as may be imposed by the learned court of C.J.M. Araria in connection with Araria PS case no. 921 of 2018.
With the aforesaid observations, the bail application stands disposed of.
