JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 354 and 354A of the Indian Penal Code.
It is alleged that the informant's daughter aged 15 years went to fetch water at the hand pump when she was being dragged by the petitioner. On alarm being raised the informant went to the place of occurrence when the petitioner escaped from the scene. It is submitted by the learned counsel for the petitioner that since there was dispute with regard to the use of hand pump, hence the accusation has been levelled. There is no injury report on record. It is further submitted that for the occurrence of 21.5.2015 at 8 P.M. the FIR was registered on 22.5.2015 at 3 P.M.
Patna High Court Cr.Misc. No.33495 of 2015 (2) dt.26-08-2015 2/2 which reached to the court of the learned C.J.M. on 25.5.2015 which suggests that the FIR has been registered by antedating. Considering the delayed lodging of the case and its delayed reaching to the court, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Sheikhpura in connection with Karandey P.S. Case No.27 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
