Petitioner seeks bail in Excise Case No.0261 C2/2018 instituted for the offence under Section(s) Section 30-A of the Bihar Prohibition & Excise Act, 2016.

As per allegation in the written report, 200 litres of country made liquor were recovered from a Tempo. It is submitted that petitioner is merely one of the passenger of aforesaid Tempo. From the prosecution report, it appears that there is no recovery from the conscious possession of the petitioner. He is in custody since 09.08.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of
