JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Amas P.S. Case No. 21 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 640 liters of Spirit from the Bolero Pick-up Van and he is said to be the owner of the said vehicle.

Submission of the learned counsel for the petitioner is that he has no knowledge of the spirit and driver has succeeded in fleeing away.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that the petitioner is the owner of the said Van.

Having heard both sides, in view of the facts and

No.20880 of 2019(3) dt.19-06-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned trial court on its own merit.
