The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Atri P.S. Case no. 437 of 2021 instituted for the offence punishable under Sections 467, 468, 419 and 420 of the Indian Penal Code.
As per allegation in the FIR, by manipulating Aadhar Cards of three persons by the petitioner, government money were transferred in their respective accounts under the scheme of Prime Minister Kisan Samman Nidhi Yojna.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is nothing on record to show that the
Patna High Court CR. MISC. No.20048 of 2022(3) dt.17-10-2022 2/2 investigating authority has found any proof that this petitioner has tampered or manipulated any document. He has never manipulated anyone's Aadhar Card.
Learned APP appearing for the State has opposed the prayer of bail and submitted that there is direct allegation of committing fraud against the petitioner.
Having heard learned counsel for the parties and taking into consideration that there is direct allegation of manipulating documents for taking undue benefit under the govt. scheme, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
