The petitioner seeks bail in a case registered for offences punishable under sections 30 (a) and 41 (i) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 20 litres of country-made liquor was recovered from the vehicle of the petitioner. It is contended that nothing has been recovered from the conscious possession of the petitioner. It is further contended that three First Information Reports were lodged on the same day, i.e., one with respect to present case under Sections of Bihar Prohibition and Excise Act, 2016, second under Section 307 of the Indian Penal Code and third under Section 25 (1-b) A/26/35 of the Arms Act. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna, in connection with Naubatpur P.S. Case No. 158 of 2018, Special Case No. 3448 of 2018.
If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
