====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with Bhabua P.S. 423 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case as the petitioner had only raised protest against the illegal gratification demanded by the prosecution party. No one sustained any injury and as such Section 307 of the I.P.C. is not attracted. Moreover, similarly situated co-accused persons have been granted bail by different Co-ordinate Benches of this Court vide orders dated 27.08.2018 and 29.08.2018 passed in Criminal

Patna High Court Cr.Misc. No.57599 of 2018(2) dt.10-10-2018 2/2 Misc. No. 49037 of 2018 and 47268 of 2018 respectively. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 423 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
