The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no eye witness in the present case and only on the basis of suspicion, petitioner has been made accused in this case. He submits that the FIR has been lodged after three days of the alleged occurrence and no plausible explanation has been given for the delay. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Patna High Court CR. MISC. No.19734 of 2023(3) dt.06-07-2023 2/2 Learned APP for the State opposes the prayer for bail and submits that there is ample evidence against the petitioner in the case diary.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Gwalpara (Arar O.P.) P.S. Case No. 225 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
