1. Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing on behalf of the South Bihar Power Distribution Company, Mr. Ajay Kumar Gautam.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 332, 353, 504, 379, 506 of the IPC and Section 135 of the Electricity Act, 2003 in connection with Wazirganj P.S. Case No.291 of 2022.
3. The learned counsel for the petitioner without going into merits of the case at the outset submits that he has instructions to make submission that petitioner will pay an
Patna High Court CR. MISC. No.26881 of 2024(2) dt.16-05-2024 2/3 amount of Rs.1,98,000/- and thereafter will prefer an appeal against the final assessment.
4. The learned counsel appearing on behalf of the South Bihar Power Distribution Company fairly submits that since petitioner is willing to pay an amount of Rs.1,98,000/- for the purposes of filing appeal as such his anticipatory bail application is not being opposed.
5. At this stage the learned counsel for the petitioner submits that the amount shall be paid on or before 06.06.2024.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Electricity), Magadh Area, Gaya in connection with Wazirganj P.S. Case No.291 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. However, the petitioner at the time of surrender shall produce a copy of the receipt showing deposit of Rs.1,98,000/- and in the event, if the receipt is not filed on the
Patna High Court CR. MISC. No.26881 of 2024(2) dt.16-05-2024 3/3 date of surrender in that event the learned trial court shall not give effect to the present order.
