JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Araria P.S. Case No. 209 of 2018 instituted for the offence under Sections 379/511 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner has been made accused merely on suspicion.
It is alleged in the written report that petitioner committed theft of bicycle of the informant. Petitioner was apprehended with stolen bicycle by the villagers while he was trying to run away. It is further alleged that on 15.04.2018 three bicycles were stolen by some unknown miscreants and on being asked, the apprehended accused (petitioner) disclosed that he committed theft of those bicycles and had sold them.
Patna High Court Cr.Misc. No.55406 of 2018 (2) dt.20-09-2018 2/2 Petitioner is said to be in custody since 17.04.2018. It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No. 209 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
