JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No one has seen the actual killing of the deceased and the dead body was found in a well. The only allegation against the petitioner is that he along with others forcibly cremated the dead body of the deceased before arrival of the police. Petitioner does not have any criminal antecedent and is languishing in jail custody since 12.05.2016.
No doubt, petitioner could be remanded in this case after five years of the occurrence but having similar allegation one co-accused has already been granted privilege of bail by a coordinate Bench of this Court. Accordingly, let the petitioner, above named, be
Patna High Court Cr.Misc. No.30891 of 2016 (2) dt.09-08-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati at Gaya in connection with Barachatti P.S.Case No. 321 of 2011.
