JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Excise case no. 236/2018 registered section 30(a)(d) of the Bihar Prohibition & Excise Act.
According to the prosecution case itself, nothing was recovered either from the conscious possession of the petitioner or from his house. He does not have any criminal antecedent and the name of the petitioner was disclosed by the labourers who were working in the field near the place of the occurrence.
Considering the aforesaid facts and circumstances
Patna High Court Cr.Misc. No.57271 of 2018 (2) dt.20-09-2018 as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Sasaram, Rohtas in Excise case no. 236/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
