Since the physical court proceeding is non-functional, due to present pandemic, COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the bench.

Earlier the application of the petitioner for grant of anticipatory bail was rejected but a wrong statement has been made in paragraph 2 of the petition that the petitioner has not

Learned Counsel for the petitioner seeks permission to withdraw this application since earlier the prayer for anticipatory bail of the petitioner was rejected vide order dated 13.03.2014 passed in Cr. Misc. No. 53390 of 2013 in connection with Tr. No. 824 of 2020, arising out of Excise Case No. 55 of 2007, pending in the Court of learned Additional Sessions Judge 2nd -cum- Special Judge, Excise, Samastipur.

This Court deprecates such filing by making false statement. However, this Court accords permission to withdraw the application.

Accordingly, this application is disposed of as withdrawn.
