The petitioner apprehends his arrest in connection with Kodhobari P.S. Case No.32 of 2023, registered for the offence punishable under Sections 302/34 of the Indian Penal Code. 3.

Petitioner happens to be the husband of the informant's sister and the allegation against him is that he killed the sister of the informant and threw her dead body.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. He further submitted that there is no eye witness to the alleged occurrence in the present case. Petitioner has been made accused only on

Patna High Court CR. MISC. No.23139 of 2024(3) dt.18-09-2024 2/2 the basis of suspicion. Petitioner has no criminal antecedent. 5.

Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail by submitting that there is ample evidence against the petitioner in the case diary.

Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

Accordingly, this application is dismissed.
