Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 384/120B of the Indian Penal Code.

The prosecution case is that the informant Arjun Prasad, being S.H.O. of Amas P.S. during the patrolling duty was informed by the drivers that one gang on the basis of forged documents are extracting money and forcing the trucks to cross the boarder without making payment of taxes. The drivers suggest that the gang is being run by co-accused Auranjeb @ Raju Khan. Consequently, the petrol dealership of Auranjeb @ Raju Khan was raided, from where several challan, insurance papers, several documents of the trucks were recovered.

Patna High Court Cr.Misc. No.35716 of 2015 (3) dt.11-09-2015 It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. There is no recovery from the petitioner and coaccused Auranjeb @ Raju Khan has been granted bail vide Cr. Misc. No. 28893 of 2015.

Since, the petitioner is accused in two other cases, this Court is not inclined to exercise the discretion, but in view of the above, it is a case for consideration of regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Amas P.S. Case No. 80 of 2015, pending in the court of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya. With the above observation this application is disposed of.
