The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 379, 354 and 504 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have antecedent of one case and were on police bail when investigation was going on, it is next submitted that the informant alleges that on 06.11.2016 at 6:00 am, he was at his door, then on account of previous dispute, eight accused persons including the petitioners, came variously armed and started abusing him, it is next alleged that Manager Gaddi and Madan

No.19830 of 2022(2) dt.18-10-2022 2/2 Gaddi ordered to kill on which petitioner no.2 assaulted him with farsa causing injury on head and petitioner no.1 snatched Rs. 20,000/- from the informant, it is further alleged that Anarul Gaddi and Mehal Gaddi assaulted informant's son and injured him and even took silver locket worth Rs. 6,000/- from the neck of informant's wife.

Learned counsel for the petitioner raises a short question and submits that since he was on police bail during the period of investigation as such this petition maybe disposed of in terms of the law laid down by this Court in case of Mahendra Prasad Singh Vs. The State of Bihar reported in 2004 (3) PLJR 491.

Considering the submissions made by the learned counsel for the petitioner, the anticipatory bail application of the petitioner is disposed of in terms of the order passed in Mahendra Prasad Singh Vs. The State of Bihar (supra). (Satyavrat Verma, J) Rishi/- U T
